IPT Webinar DLN629: Making Lemonade Out of Lemons -- Proactive Management of Incentives Deals Impacted by COVID-19

COVID-19 will continue to impact companies’ abilities to meet expected previously negotiated investment and payroll/headcount targets tied to economic development incentives.  Some states and local communities are providing blanket waivers or deferrals of requirements, and others are approaching agreements on a more individualized basis.  The presenters will provide examples of how companies and economic development agencies are approaching the impact of COVID-19 and will describe a multi-step approach that incentives and tax professionals can use to minimize negative impacts of COVID-19 on existing incentives deals and seek protections in future projects.

Learning Objectives:
Assure economic development agencies with which they are working that waivers and deferrals are supported by ample precedent through learning approaches being taken by various states and communities throughout the United States.
Recognize how force majeure provisions and similar provisions can be applied to defer or excuse performance requirements.
Formulate a multi-step approach for minimizing negative impacts of COVID-19 on existing incentives deals and how to provide flexibility for compliance in future projects.
